Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Strokes application, website, and related services (the "Service"), operated by Strokes ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account or use Strokes. By registering, you represent and warrant that:

You are at least 18 years of age.
The date of birth you provide is accurate and truthful.
You have the legal capacity to enter into these Terms.

We verify age at registration through your date of birth, which is checked server-side and cannot be changed after account creation. If we determine that you are under 18, your account will be immediately terminated and all data permanently deleted.

2. Account Registration & Security

When you create an account, you agree to:

Provide accurate, current, and complete registration information.
Maintain the confidentiality of your account credentials, including your password and any multi-factor authentication (MFA) codes or recovery keys.
Use a password of at least 12 characters. We strongly recommend enabling MFA for additional protection.
Notify us immediately at cs@strokes.company if you suspect any unauthorised use of your account.
Not share, sell, transfer, or provide access to your account to any other person.
Not create multiple accounts for deceptive or abusive purposes.

You are responsible for all activity that occurs under your account. We are not liable for any loss arising from unauthorised use of your account where you have failed to maintain the security of your credentials.

3. Acceptable Use

You agree not to use the Service to:

Violate any applicable law, regulation, or the rights of others.
Harass, bully, threaten, stalk, defame, or intimidate any person.
Impersonate another person or misrepresent your identity or age.
Upload, transmit, or distribute any content that is unlawful, harmful, abusive, obscene involving minors, or otherwise objectionable.
Attempt to access, tamper with, or use non-public areas of the Service, our systems, or other users' data.
Probe, scan, or test the vulnerability of the Service without our written authorisation.
Circumvent or attempt to circumvent rate limits, access controls, security measures, or authentication mechanisms.
Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our written consent.
Interfere with or disrupt the Service or the servers and networks that host it.
Transmit viruses, malware, or other malicious code.
Collect or harvest other users' personal information.
Use the Service for any commercial purpose not expressly permitted.

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account and reporting conduct to law enforcement where necessary.

4. Health & Medical Disclaimer

        Strokes is not a medical device, diagnostic tool, or healthcare provider. The Service provides informational and wellness-tracking features only. It is not a substitute for professional medical advice, diagnosis, or treatment.
      

Data insights, health signals, correlations, and trend analyses displayed in the app are for informational purposes only and should not be interpreted as medical advice.
Always seek the advice of a qualified healthcare professional with any questions regarding a medical condition, sexual health concern, or treatment decision.
Never disregard professional medical advice or delay seeking it because of information you read or track in Strokes.
If you are experiencing a medical emergency, contact your local emergency services immediately. Do not rely on Strokes for emergency assistance.

We make no representations or warranties regarding the accuracy, completeness, or clinical validity of any health insights, correlations, or recommendations provided by the Service.

5. Health Vault

The Health Vault allows you to store encrypted medical records (test results, prescriptions, doctor's notes, and other documents).

        Important: Health Vault records are encrypted on your device with a PIN you set. We cannot access, read, decrypt, or recover your Health Vault data. If you lose your Vault PIN, your encrypted records are permanently inaccessible. There is no recovery mechanism.
      

You are solely responsible for remembering your Vault PIN and for maintaining backup copies of important medical documents outside of Strokes.
The Health Vault is a convenience feature for personal record-keeping. It is not a certified medical records system.
Free accounts may store up to 5 records. Pro accounts may store up to 25 records. Elite accounts have unlimited storage. Individual file uploads are limited to 10 MB.

6. Subscriptions & Payments

6.1 Subscription Tiers

Strokes offers free and paid subscription tiers (Pro and Elite). Features available on each tier are described in the app.

6.2 Billing

Paid subscriptions are billed through Stripe. We do not store your credit card details.
Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select.
Prices are displayed before purchase. All prices include applicable taxes unless otherwise stated.

6.3 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period at the then-current price, unless you cancel before the renewal date. You will be charged for the next billing period unless you cancel.

6.4 Cancellation

You may cancel your subscription at any time through Settings or by managing your subscription via Stripe.
Cancellation takes effect at the end of the current billing period. You will continue to have access to paid features until then.
We do not provide prorated refunds for partial billing periods.

6.5 One-Time Purchases

Certain features (badge upgrades, streak freezes, streak restores) are available as one-time purchases. These are non-refundable once consumed.

6.6 Free Trial

If we offer a free trial, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

7. User Content & Data Ownership

You retain full ownership of all data you submit to the Service, including session logs, vitals, Health Vault records, profile information, and group/friend data.
By using the Service, you grant us a limited, non-exclusive, non-transferable licence to process your data solely for the purpose of providing, maintaining, and improving the Service.
We do not claim ownership of your data. We do not use your personal data to train artificial intelligence models.
You may export all of your data at any time (Settings → Export Data) in a structured, machine-readable JSON format, in accordance with your right to data portability.

8. Intellectual Property

The Service — including its design, features, source code, algorithms, articles, graphics, and branding — is owned by Strokes and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of any part of the Service.
Articles in the Insights section are provided for personal, non-commercial use only and may not be reproduced, redistributed, or republished without our written consent.
"Strokes" and associated logos are trademarks of Strokes. You may not use them without our prior written permission.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which describes in detail what data we collect, how we use it, the security measures we employ, your rights, and how to exercise them. The Privacy Policy is incorporated into these Terms by reference.

10. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Supabase (infrastructure), Mapbox (maps), Resend (email), Google (OAuth), and Apple (OAuth). Your use of these services is subject to their respective terms and privacy policies.

We are not responsible for the practices of third-party services. We recommend reviewing their privacy policies.

11. Suspension & Termination

11.1 By Us

We may suspend or terminate your account, without prior notice, if:

You violate these Terms or the Acceptable Use policy.
You are found to be under 18 years of age.
Your activity threatens the security, integrity, or availability of the Service.
You are the subject of substantiated user reports.
Required by law or legal process.

Suspension: Your account may be temporarily suspended for a specified period. You will be notified with the reason and duration.

Ban: In serious or repeated cases, your account may be permanently banned. You will be notified and may appeal by contacting cs@strokes.company.

11.2 By You

You may delete your account at any time through Settings → Delete Account. Upon deletion:

Your data enters a 30-day soft-delete period during which it is inaccessible but not yet purged.
After 30 days, all your data is permanently and irreversibly deleted from our systems.
A confirmation email will be sent to the email address on file.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, timely, secure, or error-free.
The results or insights obtained from the Service will be accurate, reliable, or complete.
Any defects in the Service will be corrected.
The Service will meet your specific requirements or expectations.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

STROKES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, PERSONAL INJURY, OR EMOTIONAL DISTRESS, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Strokes, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

Your use of or access to the Service.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Your violation of any third-party right, including intellectual property, privacy, or publicity rights.
Any content or data you submit to the Service.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at legal@strokes.company and attempt to resolve the dispute informally for at least 30 days.

15.2 Arbitration (Where Permitted)

If the dispute cannot be resolved informally, and to the extent permitted by applicable law, any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court.

15.3 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

15.4 Exception for EEA/UK Users

If you are a consumer in the EEA or UK, nothing in this section limits your right to bring claims in your local courts or to the protections afforded by mandatory consumer protection laws of your country of residence.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles.

For users outside England and Wales: these Terms do not override any mandatory consumer protection laws of your jurisdiction that cannot be waived by contract.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Strokes regarding your use of the Service. They supersede all prior agreements, understandings, and communications, whether written or oral.

19. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

We will update the "Last updated" date at the top of this page.
We will notify you via in-app notification and/or email at least 14 days before the changes take effect.
Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
If you do not agree with the changes, you may delete your account before they take effect.
